Welcome to TicketVort Limited (“TicketVort”, “we”, “our”, or “us”). By accessing or using our website www.ticketvort.com and related services, you agree to comply with and be bound by these Terms and Conditions (“Terms”).

These Terms govern your use of the TicketVort platform as either a Ticket Buyer or an Event Organiser. Please read these Terms carefully before using our services. If you do not agree to these Terms, you must not use this website.

2. Definitions

– “Platform” refers to the TicketVort website and all associated services.
– “User” means any person accessing or using the platform.
– “Event Organiser” refers to individuals or entities who create, manage, or sell tickets for events using TicketVort.
– “Ticket Buyer” refers to individuals who purchase tickets through the TicketVort platform.
– “Event” means any function, show, performance, or gathering listed for ticket sales via the platform.

3. Eligibility

To use the TicketVort platform, you must be at least 18 years old or have parental consent to do so. By using our services, you represent that you have the legal capacity to enter into binding agreements.

4. Use of the Platform

You agree to use the platform only for lawful purposes and in accordance with these Terms. You may not:
– Use the platform to promote or engage in fraudulent, illegal, or misleading activities.
– Interfere with the functionality or security of the website.
– Use the TicketVort name, logo, or branding without prior written consent.

5. Event Organiser Terms

5.1 Registration and Approval
Event Organisers must register for an account before creating events. All events are subject to review and approval by TicketVort before publication. TicketVort reserves the right to approve or reject any event submission at its sole discretion.

5.2 Event Listing and Conduct
Organisers are responsible for ensuring that all event information provided is accurate, up-to-date, and lawful. TicketVort reserves the right to delist or remove any event that is fraudulent, misleading, or violates these Terms.

5.3 Payments and Payouts
TicketVort collects payments from ticket buyers on behalf of organisers. Payouts to organisers will be made after the event, minus applicable fees and commissions.

5.4 Refunds and Cancellations
In the event of cancellation, organisers must promptly notify TicketVort. Refunds will be issued to ticket buyers for cancelled events. TicketVort reserves the right to withhold organiser payouts in such cases until refunds are processed.

6. Ticket Buyer Terms

6.1 Ticket Purchase
When you purchase a ticket through TicketVort, you agree to provide accurate and complete information. Tickets are issued electronically and serve as proof of purchase.

6.2 Refund Policy
Tickets are non-refundable except in the case of event cancellation. If an event is cancelled, TicketVort will process refunds on behalf of the organiser within a reasonable period.

6.3 Event Responsibility
TicketVort acts only as a ticketing platform and is not responsible for the organisation, quality, safety, or fulfilment of events. The responsibility for event execution rests solely with the organiser.

7. Fees and Charges

TicketVort may charge service or processing fees on ticket purchases. All prices displayed on the platform are inclusive of applicable taxes unless stated otherwise.

8. Intellectual Property

All content on the TicketVort platform—including logos, text, graphics, software, and layout—is the intellectual property of TicketVort Limited or its licensors. Users may not copy, distribute, or reproduce any content without prior written consent.

9. Limitation of Liability

TicketVort shall not be held liable for:
– Any injury, loss, or damage resulting from attendance at events.
– Any delay, cancellation, or alteration of an event by organisers.
– Indirect, incidental, or consequential damages arising from the use of our services.

Our total liability, in any circumstance, shall not exceed the total amount paid for the ticket or service in question.

10. Privacy

We value your privacy. Information collected through our platform is handled in accordance with our Privacy Policy. By using the site, you consent to such collection and use.

11. Dispute Resolution

11.1 Arbitration
Any dispute or claim arising out of or relating to these Terms shall first be resolved through arbitration in Nairobi, Kenya, conducted in accordance with the Arbitration Act (Kenya).

11.2 Governing Law
If arbitration fails to resolve the dispute, it shall be governed by and construed under the laws of Kenya, and the parties submit to the jurisdiction of Kenyan courts.
